I understand that there are "fair use" laws, which allow the use of copyrighted materials without compensating the owners as long as no one is claiming any ownership or making any money, but wouldn't the sites this would be hosted on be hosted by companies that would at least be deriving advertising revenue from the attraction value of the content on their sites?
It seems to me I've heard of various cases where such companies have tried to claim that they're not responsible for what their users post (various content "sharing" sites and such), but those arguments haven't held up - if they're given a "desist notice" by the copyright owners, they have to take the infringing content down. I know parody creators (like Weird Al Yankovich, for example) have to get permission from the copyright holders of the things they make parodies of.
I'd be pretty surprised if hosting it in a way that made anybody any money, directly or indirectly, wouldn't require that you get Blizzard's permission or pay them some contractually agreed upon royalties, and I'd guess that their reputation management policies would prevent them from being up for that in this case.
The other possibility might be to make it free to players, and free of ads, and have it hosted somewhere that hosts it in a way that is entirely free of ads. Then no one involved would be directly or indirectly deriving any revenue from it, which would damage, but not entirely destroy the civil case against it; they still have the argument that if their content is "maligned" or in any way provided by someone else, it damages their ability to derive revenue from their material.
I think in many cases, creators of pornographic works have successfully fought such infringement suits by claiming the right of freedom of expression. But to fight you have to have money. (Which is why money rules the world - money has to determine what gets quick (as in before we die of old age) judicial attention, otherwise it would be impossible to pay for the livelihoods of all the judges that would be required to deal with all the conflicts.) And if you don't fight, the very least that happens is you get ordered to take it down. (If they notice you and decide to bother with it, which I guess they might not.) You can try to get civil rights orgs to help you fight, but I'd guess they'd be unlikely to choose to take up this particular cause. (It's about impossible to get them to take up any case that hasn't already captured a lot of public attention. Which makes sense because after all, fighting costs a ton and they don't have unlimited amounts of it.)

Yeah, it's impossible to stand your ground against Blizzard, that's pretty obvious. If we do have a confrontation with them, we'll remove all our content from the public's reach (we thought about continuing development "underground", but hopfully it will never come to that). But if we look around, we'll see such projects as WhoreCraft, who require to actually buy their game. And they are much more popular than us, but they don't do anything to hide or evade Blizzard's possible wrath (they use 3D-models straight out of WoW, but with slight modifications for the adult content and on another game engine). Also, there's a project based on Overwatch which is much more popular and has existed longer than ours. I do understand that anything might happen and somebody will be the first. We do everything we can not to be them.

There is no real animation to speak of in this game, which is a real pity as it really needs animation in most if not all scenes to help carry the game and keep the player interested, the MC was pretty looking, but for her height and weight, melon sized boobs was the wrong option.
